Knowledge of Rules, 16.47.1.10 TRAINERS (C)(5) and whether a penalty or other disciplinary action should be imposed.

Aggravating factor: Wesley Giles did not properly identify the horses upon arrival at his barn.

Mitigating factor: The horses “My Candy Girl " was not properly identified by the Veterinarian administering Lasix. Mitigating factor: The horse “My Candy Girl " was not properly identified by the track’s horse identifier.

Note: No evidence was presented to disprove the findings of the New Mexico Racing Commission.

The Stewards posted the Inquiry sign, spoke with the rider of the #9, Giovani Vazquez-Gomez, reviewed the race replay and determined interference by #8 caused the #9 from placing higher. #8 Angel in the Wagon was disqualified and placed 7th behind the #9.

Upon receipt of this Ruling, James A. Flores is required, within thirty (30) days, to pay any and all fines imposed to the Kentucky Horse Racing Commission. Failure to do so will subject the licensee to summary suspension pursuant to 810 KAR 3:020 Section 15.

The Stewards' Inquiry sign was posted, but no action was necessary as the interference did not affect the outcome of the race.

Upon receipt of this Ruling, Diego Villamil Bocanegra is required, within thirty (30) days, to pay any and all fines imposed to the Kentucky Horse Racing Commission. Failure to do so will subject the licensee to summary suspension pursuant to 810 KAR 3:020 Section 15.

After a hearing before the Board the Stewards on March 26, 2024, Germarius O'Neil, who rode #9 AFTER SCHOOL in the sixth race at Sandy Ridge at the Red Mile on March 25, 2024, is hereby fined Three Hundred dollars ($300) for violating 810 KAR 4:040 Section 12, and 810 KAR4:040 Section 13 for careless riding by allowing his horse to drift in across approximately half the field. An Objection was lodged by the rider of the #1 JAZZY ANNA against the #3 SIX JESS, and after review of the videos, the #3 SIX JESS was disqualified and placed behind the # 1 JAZZY ANNA.

2. After further investigation it was determined the trainer (Armando Castellanos)for “Masters Hand” did not send the text message for his entry from his phone number. Rather the text message came from a different number, an unknow person who stated he had nothing to do with racehorses. After reviewing Mr. Winsor’s phone contacts, the unknow number was incorrectly listed as being trainer Castellanos’ contact information. That resulted in Mr. Winsor failing to confirm the entry had in fact come from the trainer on file for the horse.

For this violations, the Board of Stewards assesses a Two Hundred Fifty Dollar fine.($250.00) This fine is to be paid on or before April 23, 2024, in accordance with 15.2.3.8 (B)(3)(l) . Failure to pay the fine within the time prescribed shall result in immediate suspension.

For this violation (second offense of 2024), the Board of Stewards assessed Jockey Jose Enriquez a fine in the amount of One Thousand Dollars. ($1000.00) and a seven-day (7) suspension starting March 10,2024 through March 16,2024. This fine is to be paid on or before April 1, 2024, in accordance with 15.2.3.8 (B)(3)(l). Failure to pay the fine within the time prescribed shall result in immediate suspension. Jose Enriquez may ride in designated races.

Aggravating Factors: 1. 1st offense of hitting his mount more than 15 times consecutively. 2. 2nd offense of hitting his mount more than 10 times consecutively.

Licensee is found to be in violation of: 15.2.5.13(E)(6)(A) Use of riding crops. Although the use of a riding crop is not required, any jockey who uses a riding crop during a race shall do so only in a manner consistent with exerting his or her best efforts to win. 15.2.5.13(E)(6)(e) Use of riding crops. Indiscriminate use of the whip is prohibited including whipping a horse: on the head, flanks or on any other part of its body other than the shoulders or hind quarters except when necessary to control a horse; during the post parade or after the finish of the race except when necessary to control the horse; excessively or brutally causing welts or breaks in the skin; when the horse is clearly out of the race or has obtained its maximum placing; persistently even though the horse is showing no response under the riding crop; or striking another rider or horse.

In addition, Mary Meza has accumulated “4 points” for 1st violation in 365 days, Ipratropium is under the multiple medication violation point system. Per 15.2.6.9 (O)((7)

In accordance with 15.2.1.9 (C)(21)(b), Mary Meza will be excluded from all areas and grounds under the jurisdiction of the NMRC. Additionally, effective upon applicable suspension dates, all horses owned, trained, or under the care of Mary Mezaa are ineligible to be entered or start in any race in this jurisdiction, per 15.2.1.9 (C)(21)(c). All transfers and sales of horses trained, owned, or in the care and custody of Mary Meza must be done in accordance with 15.2.6.9A(12)(a)(b) Medication and Prohibited Substances.

Amendment A: September 13, 2023

On September 12,2023, a Stewards hearing was conducted into the matter of a positive drug test for Exercise Rider Juan Carlos Sica. The sole issue for this hearing is to determine if the licensee should remain suspended pending a final disciplinary hearing. After Mr. Sica’s request to be reinstated Stewards determined that it was not in the Best Interest of horse racing to reinstate at this time till a final hearing on the facts of the case can be heard. Juan Carlos Sica will remain Summarily Suspended until such time. Refer to D.T.R.C Rule 18.1.5.3.

Amendment B: October 3, 2023

Exercise Rider Juan Carlos Sica appeared before the Board of Stewards for his Final Disciplinary hearing in the matter of his failed random drug test on October 3, 2023. Laboratory Corporation of America (LabCorp) reported that the sample provided by Juan Carlos Sica confirmed the findings of the initial test by the Commission of Amphetamines (1041 ng/ml), Methamphetamine (3000 ng/ml). Stewards reviewed the information provided to them. Stewards have lifted the Summary Suspension and will “SUSPEND” exercise rider Juan Carlos Sica from October 3, 2023, to and through December 31, 2023 (90 days). Mr. Sica must submit to a professional evaluation by a substance abuse professional and will be required to fulfill all rehabilitation prescribed by the counselor. The substance abuse professional “MUST” be approved by the Commission. Mr. Sica must provide to the Commission upon completion of his rehabilitation a “Negative” drug test to be eligible to submit an application of license with the D.T.R.C. Pursuant to D.T.R.C. Rules 21.4 All, 21.5 All and 21.8 All.

Juan Carlos Sica is “Denied” all access to the grounds under the Jurisdiction of the Delaware Thoroughbred Racing Commission.

Amendment C: April 17, 2024

After submitting to a professional evaluation by a substance abuse professional fulfilling all prescribed rehabilitation and providing the Board of Stewards with a negative drug test, Exercise Rider Juan Carlos Sica is restored to good standings and is eligible to apply for a license application with the D.T.R.C.

The original lab report indicated a finding of Firocoxib confirmed in the blood (15.2.6.9). Split sample rights as provided in 15.2.6.10 (D) NMAC, were afforded to the trainer and owner, and were declined.

Shaun Hubbard, B Ray Willis, Bill Finn, and Javier Rodriguez are the owners of record for the horse “American Sniper Show.”

For Christopher G O’Dell’s 1st Class 4-C medication violation, in a 365-day period, issued in accordance with 15.2.6.9 (B)(4), the Board of Stewards assess a penalty as follows:

1. A ($1000.00) One Thousand dollar fine to paid on or before September 5, 2022 in accordance with 15.2.3.8 (B)(3)(l) NMAC. Failure to pay fine in prescribed time will result in an immediate suspension.
2. In addition, Christopher G O’Dell has accumulated “0” points prior to this ruling and “0.5” points in connection with this ruling for a current total of "0.5", under the multiple medication violation point system.

Appeal Procedures An appeal under this section must be filed not later than 10 days after the date of the ruling. If the deadline falls on a Saturday, Sunday or legal holiday, the period is extended to include the next day that is not a Saturday, Sunday, or legal holiday. The appeal must be received by noon, at the main commission offices or with the stewards who issued the ruling and must be accompanied by a fee in the amount of $400. The fee must be in the form of a money order or cashier's check. Last date for appeal is August 16, 2022.
